Terms and Conditions
Last Modified: April 10 2024 PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ACTIVATING OR USING ENDCASH. BY DOING SO, YOU ACCEPT AND AGREE TO BE BOUND AND TO ABIDE BY THESE TERMS AND CONDITIONS.

IF YOU DO NOT ACCEPT, AGREE WITH OR DO NOT WISH TO BE BOUND BY THE TERMS OUTLINED, YOU MAY NOT ACCESS OR USE ENDCASH.
Acceptance The following terms and conditions (collectively, the "Terms") apply when you register, access, download or use Endcash or its services and all associated sites linked to Endcashsupport@rfhl.com, or the Endcash mobile application platform or any similar platform (collectively, "Endcash"), operated by Republic Bank (Barbados), on any device. By you accepting or agreeing to the Terms, this will constitute a legal contract (the "Agreement") between you, being at least 18 years of age, an individual user of or a customer or beneficiary of any service offered by Endcash. By accepting or agreeing to the Terms, you automatically and immediately agree to all the Terms.

In addition to these Terms, you will be subject to the applicable Terms of Use Agreements for your debit or credit cards and the Bank’s General Terms and Conditions which can be found on its website.
Eligibility You must have the power, authority and capacity to accept these Terms. By accepting the Terms or by using Endcash, this indicates that you are 18 years of age and have not been previously suspended, removed, or disqualified for any reason, from accessing Endcash. Impersonation, false statement or other misrepresentation of your identity, age or affiliation with any person or entity is a violation of this Agreement. In the event of any violation of the Terms, the Bank reserves the right to suspend or permanently prevent you from accessing Endcash and its services. EndCash will only work on compatible smartphones and compatible operating systems, such as iOS and/or Android that enable internet access and certain functionalities which will only work when connected to the internet. By accepting the Terms or by using Endcash you represent that you own the mobile device onto which Endcash will be downloaded, or have received consent from the owner to do so.
Other Terms and Conditions Additional terms and conditions may apply in order for you to access any specific Endcash service and to specific portions or features of Endcash, including contests, promotions or other similar features, all of which are made a part of these Terms by this reference. If there is a conflict between these Terms and the terms posted for or applicable to a specific service of Endcash, the latter terms shall prevail.
Privacy Policy When registering, we collect specific information to verify your identity, to enable the use and access to Endcash (and its services). You authorise Endcash to collect and use your information in accordance with the applicable privacy policy as may be amended from time to time, which is available here.>.
Use of Endcash services Except for information, products or services clearly indicated as being supplied by Endcash, we do not operate, control, or endorse any information, products or services on the Internet in anyway. The Bank has used reasonable endeavours to ensure that your login access and transactions performed by use of EndCash are adequately protected and authenticated and we have put certain security measures in place which include but are not limited to multi-factor authentication. The Bank cannot and does not guarantee or warrant, however, that files available for download through Endcash will be free of viruses, worms or other codes that may be damaging. Therefore, you are responsible for implementing procedures to satisfy your particular requirements of internet security and for accuracy of data input and output.

Set up and Safety requirements
1) Only one account can be registered/set up per user.
2) Accurate and complete information must be provided during the registration/on-boarding process.
3) The login data is intended solely for your personal use and therefore always to be kept secured and safe.
4) You should not share or otherwise disclose your login details with third parties.
5) You must inform the Bank immediately on becoming aware of and/or suspecting a case of any unauthorized use, disclosure and/or misuse of your access data or of your user account via the ‘contact us’ feature on the Endcash platform or email at endcashsupport@rfhl.com or telephone at (246) 227 – 2700.
6) Moreover, you must not use the user account of another person.

You must comply at all times with any technical and security requirements that the Bank establishes with EndCash or the use of its products or services from time to time.

Submission of the duly completed registration form extends an invitation to the Bank to make an offer to enter into the agreement and the Bank is entitled to reject individual users without giving reasons. You guarantee that any personal data submitted is in all respects complete, true, accurate and not misleading. Your personal data should be promptly updated as needed. The Bank is entitled to request any information it deems necessary or desirable for validating your identity or any aspect of the transaction or the source of its funds and such information must be provided in full, immediate upon request. The Bank is entitled to impose such restrictions and limitations as it advises you from time to time on transactions, including daily and aggregate limits.
Prohibited Conduct You also agree that by accessing or using Endcash, you and/or your transactions will not:
1) Violate any law, statute, ordinance or regulation.

2) Relate to transactions involving (a) illegal narcotics, illegal steroids, controlled substances or other products that present a risk to consumer safety, (b) drug paraphernalia, (c) items that encourage, promote, facilitate or instruct others to engage in illegal activity, (d) stolen goods including digital and virtual goods, (e) the promotion of hate, violence, racial or other forms of intolerance that is discriminatory or the financial exploitation of a crime, (f) items that are considered obscene, (g) items that infringe or violate any copyright, trademark, right of publicity or privacy or any other proprietary right under the laws of any jurisdiction, (h) illegal sexually oriented materials or services, (h) ammunition, firearms, or certain firearm parts or accessories, or (j) weapons or knives regulated under applicable law.

3) Relate to transactions that (a) show the personal information of third parties in violation of applicable law, (b) support pyramid or ponzi schemes, other “get rich quick” schemes or certain multi-level marketing programs, (c) are associated with purchases of annuities or lottery contracts, lay-away systems, off-shore banking or transactions to finance or refinance debts funded by a credit card, (d) for the sale of certain items before the seller has control or possession of the item, (e) are by payment processors to collect payments on behalf of merchants, (f) are associated with the sale of traveller’s checks or money orders, (g) involve currency exchanges or check cashing businesses, (h) involve credit repair, debt settlement services, or insurance activities, (i) involve structured lending products or, (j) involve offering or receiving payments for the purpose of bribery or corruption.

4) Involve the sales of products or services identified by government or regulatory entities to have a high likelihood of being fraudulent.

5) Post content which is:
a) related to or connected to any of the matters referred to at (1) to (4) above.
b) false, misleading, deceiving, inaccurate or dishonest;
c) defamatory or invasive of another person's right of privacy or right of publicity;
d) harmful, obscene, harassing, abusive, offensive, objectionable, violent or condoning violence or harm, displaying nudity or sexual activity, or otherwise unfit for publication;
e) portraying or inciting animal cruelty or neglect;
f) infringing intellectual property or other proprietary rights of any party, or not authorized, such as content that you did not create or do not have the permission to use;
g) creating a privacy or security risk to any person;
h) in the Bank’s sole discretion, is objectionable or exposes users to harm or liability.

In the event you carry out prohibited conduct or post or submit any of the above-mentioned prohibited content the Bank reserves the right, in its sole discretion, without penalty, and without notice, to suspend or terminate your account.
Termination; Agreement Violations The Bank reserves the right, in its sole discretion, without penalty, and without notice, to suspend or terminate your account or access to Endcash, in whole or in part, at any time due to suspected fraudulent, abusive or illegal activity occurring on your account. The Bank will not be liable to you or any third party for any such termination or interruption. Any suspected fraudulent, abusive or illegal activity may be referred to appropriate law enforcement authorities. These remedies are in addition to any other remedies the Bank may have at law or in equity.
LIMITATION OF LIABILITY AND DAMAGES In no event will the Bank or its contractors, agents, subsidiaries, affiliates, partners, employees or representatives be liable for death, personal injury, property damage, or any special, indirect, incidental, consequential, punitive, or exemplary damages whatsoever, including, without limitation, damages for loss business opportunities, lost revenues, loss of or damage to data, business interruption, or any other commercial or financial damages, or other losses of any kind, arising out of these terms or in any way related to your use or inability to use Endcash. You acknowledge and agree that the above limitations or exclusions will apply to you subject to applicable law. This paragraph shall survive the termination of this agreement.
INDEMNIFICATION You agree to indemnify, save, and hold the Bank, its affiliates, employees, officers, directors and partners harmless from any and all claims, losses, damages, and liabilities, costs and expenses, including without limitation to legal fees and expenses, arising out of or related to: (i) your use or misuse of Endcash; (ii) any violation of this agreement; or (iii) any breach of the representations, warranties, and covenants made by you herein. The Bank reserves the right, to seek all remedies available at law and in equity for violations on this agreement, and you agree to cooperate with the Bank’s defence in settlement of these claims. The Bank will use reasonable efforts to notify you of any claim, action, or proceeding brought by a third party that is subject to the foregoing indemnification upon becoming aware of it. This paragraph shall survive termination of this agreement.
REFUND POLICY

REFUND PURCHASES
Transactions by Endcash shall be subject to the refund policies existing from time to time by merchants on the Endcash platform. The Bank shall not be liable for any refund or exchange. In the event that a refund or exchange has been agreed between the merchant and the customer, the Endcash merchant will be responsible for all refunds to your Wallet.
FUNDING OR LOADING WALLET You are responsible for inputting the correct details of the mobile number, credit or debit card from which you load the Wallet. The Bank is not responsible for any instance where an incorrect mobile number or card information is used. However, if a load was processed and the funds have been charged to your credit or debit card but not loaded to the Wallet within twenty-four (24) hours of completion, you must inform customer service via the ‘contact us’ feature on the Endcash platform or via email to endcashsupport@rfhl.com or telephone at (246) 227-2700.
Please include the following details in the communication:
• The mobile number
• last 8 digits of the card used
• Operator name
• Load amount
• Transaction date
• And confirmation number

The Bank will investigate the incident and, if it is found that money was indeed charged to your card without delivery of the load, you will be refunded within a minimum of thirty (30) working days from the date of receipt of your dispute. All refunds will be credited to the card used.
Cash-out to Bank Account, Cash or Cheque at a Branch You are responsible for accurately designating the bank account number to be credited with the funds from your Endcash mobile wallet (“Wallet”). The Bank is not responsible for any instance where an incorrect bank account number is used. However, if a cash-out was initiated and the funds have been debited from your Wallet but not applied to your account within twenty-four (24) hours of completion, you must inform our customer service via the ‘contact us’ feature on the Endcash platform or email at endcashsupport@rfhl.com or telephone at (246) 227 – 2700 within 2 business days of completion.

Please include the following details in the communication:
- the mobile number
- bank account information
- Customer name
- cash-out amount
- transaction date
- and confirmation number
If you do not have a bank account with Republic Bank (Barbados) Limited to cash-out directly from the Endcash application, cash outs can be facilitated at any of our Republic Bank branch branches via cash or cheque. Cash outs can also be facilitated directly to any local bank account via Automated Clearing House (ACH) direct transfer.

Fees are applicable when cashing out from your Wallet and may change from time to time at the discretion of the Bank. Access to the requested funds in your wallet will be unavailable once the cash-out is completed.
DEPOSIT INSURANCE Any funds in your Endcash wallet (regardless of the amount) will not be insured or guaranteed by the Deposit Insurance Corporation (“DIC”) as this type of account does not qualify for insurance coverage by the DIC.
Disclaimer; No Warranties To the fullest extent permissible pursuant to applicable law, the Bank disclaim(s) all warranties or guarantees – whether statutory, express or implied – including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights. The Bank does not warrant against interference, delay, interruption or disruption with your use of Endcash. We do not authorise anyone to make any warranty on our behalf and you should not rely on any such statements, other than those expressly stated herein. The Bank does not warrant that Endcash will be uninterrupted or error-free or that defects in the site will be corrected. The Bank will not be liable for any circumstances that interrupt, prevent or otherwise affect the functioning of Endcash, such as unavailability of your wireless service, communications, network delays, limitations on wireless coverage, system outages, or interruption of a wireless connection. The Bank disclaims any responsibility for any wireless service used to access or use Endcash. The Bank is not responsible for your supported device or the software or hardware it contains and makes no representations, warranties, or guarantees regarding same. This paragraph shall survive the termination of this Agreement.
Modification of this Agreement The Bank reserves the right to impose and revise fees or charges, revise this agreement or any Endcash service at any time by posting notification through Endcash or various banking communication channels. The changes will become effective, and be deemed accepted by you, thirty (30) days after the initial posting and applicable thereafter and will also be reflected as the revised agreement by updating the date indicated after "last modified" at the beginning of these terms and conditions. Revised Terms will be uploaded to the Endcash application for viewing. Your continued use of Endcash following the posting of changes will constitute your acceptance and agreement to the changes. If you do not agree with any such change, you are required to immediately discontinue your use of Endcash.
Communication As a condition to activating and using Endcash, you consent to receiving Endcash enabled messages on your supported device (i.e., SMS, push notifications) from the application. You agree to receive notices and other communications from Endcash by telephone or email via the contact information provided on registration or posts within your online account, or through the messaging capabilities of Endcash. Any notice or communication to the Bank regarding the Endcash platform or service is required to be performed by way of the ‘Contact Us’ feature on the Endcash platform, via email at endcashsupport@rfhl.com or telephone at (246) 227-2700.
Waiver The failure of the Bank to exercise or enforce any right or provision of this Agreement will not constitute a waiver of such right or provision. Any waiver of any provision of this Agreement will be effective only if in writing and signed by the Bank. the Bank.
Severability If any provision of this Agreement is determined to be invalid or unenforceable pursuant to any applicable law, then that provision will be limited or eliminated from this Agreement to the extent required by law, and the remaining provisions will continue in effect. The terms of this section will survive termination of this Agreement, together with any express term or provision which, by its nature should survive.
Dispute Resolution If any dispute shall arise between the parties in connection with or arising out of the Agreement, either party may take immediate steps to have the dispute settled by binding Arbitration administered by the Arbitration and Mediation Court of the Caribbean (“AMCC”). The appointing authority shall be AMCC. Arbitration shall be conducted in accordance with the UNCITRAL Arbitration Rules as at present in force. The number of arbitrators shall be one and the place and law of arbitration shall be Barbados.
Governing Law This Agreement shall be governed and construed in accordance with the laws of Barbados .
